I am having the same situation.
Could you share some insights which I can ask my lawyers to file a case? Such as the name/type/direction of related laws.
Many thanks.
After me initiating an inquiry, my lawyer casually emails me that I (co-applicant) âwas already pre-approved. However, for the past few months, there have been no available appointments.â And that they are on the lookout for appointment openings. I donât even know when I was pre-approved! My application was filed on 22 March 2022. Any insights on when AIMA will reopen appointments for biometrics? Thanks.
Are you the primary applicant? Was anyone you applied with submitted in 2021?
Sole co-applicant. Husbandâs biometrics got done in Oct 2023.
Apologies but Iâm not sure that I understand the âsole co-applicantâ status and confirmed pre-approvals from 2022 primary applicants would be big news, so I want to be clear.
You are on the same application as your Husband? Not a separate application with your own investment/etc?
When was your husbandâs application?
Sole co-applicant means I was the only one on my spouseâs application. He applied Dec 2021. Mine was submitted 3 months later. Hope that clarifies.
Thanks, that means you are a family reunification applicant rather than a direct GV applicant.
Implies AIMA is processing family reunifications (to already approved applicants) ahead of main applicants.
Has anybody been successful getting a biometric appointment after not making an appointment when slots opened up? I was offered appointment slots in Dec '21, but could not travel due to eye surgery (not to mention the Omicron wave), and since then have not been offered an appointment. I appear to be âout of the systemâ, and my lawyer sued on my behalf in June '23, but it has still not been heard (deemed not urgent because I donât live in Portugal). Other than waiting for the lawsuit to be heard, has anybody else been successful in resurecting their application status once dropped. Thank you!
Lawsuit seems to be the way to go, but without urgency you could be waiting years for that to resolve.
Do you have any evidence of informing SEF back in 2021 that you could not attend and your justification?
If not, your case may be considered as âdesertedâ and hence closed.
So I would recommend checking with your lawyer if you have solid grounds behind your lawsuit, otherwise you could be waiting for years on a pre-lost case.
The other option is to withdraw the current lawsuit and then move to Portugal and open the new case as urgent this time. Thereâs obviously many ways on how you can âmove to PortugalââŠ
I donât think my lawyers ever contacted SEF. Back then, they told me that there is no problem, and that I can make an appointment when the next round is opened up in 4-6 months. Little did they (or I) know, that there was the glitch in the system in which I was dropped for future appointments. Uggh. I think your advice of dropping the current lawsuit and re-applying as urgent the day I arrive might be my best bet. Thank you so much for your thoughts!
We are in the same situation, received an invite in 2023 after being pre-approved Dec 21. Lawyer advised us that we did not need to do anything but wait for a future invite round. Weâve discussed the lawsuit option but been told we are unlikely to be successful as we are not in Portugal. Lawyers maintain that it is a matter of timeâŠ
That is crazy since the opposite has been common knowledge here for a while, I think.
Might be worth naming the lawyers / firms giving thid terrible advice so others can avoid them.
Reposting my earlier post:
A personal anecdote regarding some âlawyersâ - as some of you guys know I switched the lawyer mid-way through the process some 6 months before my biometrics invite. The âold lawyerâ was still emailing me occasionally saying some rubbish like âgood news, we are making progressâŠâ, or âdonât worry so and so told me your GV is being issuedâ.
What a piece of workâŠ
Heard from my lawyer that slots for May and June are open, but not for my dependents. Anyone heard anything?
can someone confirm this, please? ive been preapproved end of January and still havenât heard anything from my lawyer regarding biometrics app.
Did you actually asked your lawyer? I remember that there were few in February.
Bio slots opened late Jan last time. Any idea when is the next time window to open slots for dependents?
anyone got bio slot recently?
regular queue blaims it systems at aima while some guys who win court cases got bios in april
Cross posted. Apologies.
Preliminary Approval for Golden Visa (ARI) received for primary and spouse in early May 2024. So just barely under 2-1/2 years from initial application at very end 2021. Attorneys say no biometric appoints yet available. They say we have 2 months after appointments open to schedule. Or what? Anyway, changed plans over last 2 years so now not intending to move to Portugal immediately. Life moves on rapidly.
