No cards yet. Hopefully very soon. The next milestone is this coming Friday, 17 Nov when the court indicated they had to make the decision. Unknown at the moment what happens if they don’t. Hoping to pickup cards from the atty office in early Dec while on the scheduled vacation.

My situation is the same as yours. Contacted lawyer and got the same offer 1k for lawsuit.
Agreed with the price and told lawyer to proceed. Hope I will be able to write some update here early next year.

Has anybody switched immigration lawyers in order to file the SEF/AIMA lawsuit? If so, then what was the process to transfer case details from your current lawyer to the new one?

I ask because I have been quoted an estimate of between €1350 and €2150 plus VAT with an additional 20% charge for each additional family member (I have one spouse) by my lawyers. This is “for drafting and filing the initial claim”.

Not only is the fee somewhat higher than others here have been quoted, it is not capped and the language used talks about the “initial claim” which leads me to suspect there may be other steps that are chargeable later in the process.

I strongly suspect that the filing of this lawsuit has become a boiler plate process for these law firms and it’s money for old rope. So, my question: has anyone switched law firms to do this and what was the process?

Today’s the big day!

I am in the process of switching now for that same reason ( a court case to progress my application), it was suggested by my current firm ( which is a professional services firm not lawyers) that a PT law firm is needed for the court case.
The transition had been very smooth so far with everything sent over to the new firm the same day by email & hard copy to be picked up at their offices.

We just switched. It has been fairly straightforward. We had a Zoom call with the new lawyer where we explained our situation. We were then told about the process, fees, etc. We had to email our previous lawyer, pay the balance owing and then they would start the handover process to the new legal team. All we had to do was supply some basic documentation to the new lawyer, passports, VC fund documents, house purchase/sale, essentially anything that they could use to help strengthen the lawsuit.

So its the 17th and, big surprise, no approvals yet. That noted, I was copied on a stream of emails between our attorney and the AIMA. In this exchange, there were requests for clarifying documents, current status of our fund investment status, etc. The lawsuit has achieved part of its objective, at least, in that it has moved our app forward and the AIMA folks are in fact reviewing it. This is the most progress in quite a while. The AIMA is now in violation of the court order - I have no idea of what the consequences of that are. But, with our firm promptly providing requested documents, am hoping that this week brings favorable news.

Nov 24 update: the gears continue to slowly turn. Update from the attorneys was that they had been in contact with AIMA and that a mandatory checking the database of the Security Intelligence Service was in process. Eventually they will run out of things to check or approve. Optimism grow (just a little bit.)

I filed a lawsuit. I’m an early 2023 GV submission and went with urgency on the law suit since my kids are in there 20s and I went the start a company route . It’s been 2 weeks and we will see!!!

If you dont already live in PT I fear the lawsuit may be a lost cause.

Got to do what you have to do … I’ve got a company now in Portugal with 30 employees now and was waiting on residency card based on GV application. I’ll take my chances with the lawsuit …

Kristen, I edited an update from the 17th, but here is current status:

Nov 24 update: the gears continue to slowly turn. Update from the attorneys was that they had been in contact with AIMA and that a mandatory checking the database of the Security Intelligence Service was in process. Eventually they will run out of things to check or approve. Optimism grows (just a little bit.)

Our trip planned a year ago begins next Sunday. Hoping some or all of the 11 days will count. If not, its still a nice visit to the Country. If we do get the accounts issued early enough, will tack on a couple days to meet the 14 day requirement.

I had few discussions with my lawyer about a lawsuit, but in the end, I’ve decided not to pursue. The main reason was that she told me unlike preapprovals, SEF was not under any legal obligation to decide in 90 business days for final approvals. She didn’t provide me with any details; I did not ask for it either. She also said I needed to demonstrate hardship to have a strong case. I hope she is wrong, for sake of those with pending cases…
