I believe we are “Cooked” as the kids would say. Let’s see if it goes through the courts and el presidente… Still, not a great feeling, a slap in the face to all GV investors, even with lobbying organised.

I would’ve been eligible in 2027 but now looks like it’ll be 2037 if I get my residence card next year or more like 2038 and passport in 2040. This is a joke.

More like 2043 because IRN is currently processing citizenship applications from 2021.

If you are a Portuguese citizen, especially a business person transacting overseas, know that this violation of basic norms of commercial dealings will be remembered for generations, and your country and its people, who ultimately elect these governments and politicians, will be forever tainted with this act of dishonesty and deceit. This was FRAUD by a nation state, nothing less. Many of us put our life savings into this, and planned our lives and children’s futures around this, and the impact of this treachery is immeasurable.

Socialists only seem interested in punting one bit of yesterday’s legislation to the TC - not the bits most GVs are interested in.

Don’t think we need to rely on the Socialists and/or President to get an appeal to the TC (for example, on ignoring arbitrary AIMA wait times for approval that can span 3-5 years)?

Asked if the Socialist Party is considering requesting a review of these decrees again, the socialist said that the party will assess the matter, but only in relation to the decree on the ancillary penalty of loss of nationality because regarding the nationality law “the issues of unconstitutionality have been resolved”.

Asked if the Socialist Party (PS) will wait for the decision of the President of the Republic, António José Seguro, regarding these decrees, Pedro Delgado Alves stated that “they are two different issues” and that “the deadline runs simultaneously for both,” meaning “when there is a decree, it will be eight days for both.”

“Therefore, regardless of what the President of the Republic decides to do, we will obviously have to analyze the final result of the decree and, when we do, we will make a decision. If, however, the President of the Republic presents it, it becomes redundant to do so, but initially, in exactly the same terms as we proceeded in December of last year, we will analyze the law and, if we conclude that it is justified, we will do just that,” he explained.

“There were concessions from both sides on issues that were very important to us, as I said, the range of crimes, the inclusion of new crimes for loss of nationality (…). The law was approved but still needs to clear several hurdles. President Seguro has up to twenty days to promulgate, veto, or refer it to the Constitutional Court for preventive review. The latter is widely considered the most likely outcome: a previous version of this law was partially struck down by the Constitutional Court in 2025, and some of the same structural issues remain. If referred, the Court has twenty-five days to issue a ruling. If the law survives, the Government then has ninety days to update the implementing regulations. A realistic estimate puts full entry into force somewhere in mid to late 2026.

He has 8 days to decide on a TC referral, 20 days to veto/promulgate.

And i think that even if they don’t regulate the law, it still has effect.

Regulations do not play any role in the effective date of the law.

Eg our favorite current law was amended in 2024 but never regulated, but it is still the law in force today.

This is the best thing we can do right now. We need the TC to have GV points brought before them. Last time the PS party unexpectedly referred it and they did not include any GV references. We have different concerns that have not yet been addressed.

I will be stressing:

  1. ARI investors made a financial commitment based on the understood 5 year residency requirement for citizenship. This change to 10 years goes against legitimate expectations and is retroactive change for us since we invested.
  2. ARI investors were intentionally deprioritized by AIMA. This goes against legitimate expectations and Legal certainty and foreseeability.
  3. Removing the time from being counted toward citizenship from the first application and reverting to the issuance of the first residence card, which can take many years during which ARI investors were intentionally deprioritized from receiving, represents a retroactive change.

Keep it professional and respectful. The President is our best hope since in the past the PS party has not brought in GV concerns.
