Unfortunately the law is always from the date of card insurance, in 2024 the changes to be from application was applicable for the nationality which they want to change it now again to the card it is really funny what the government are doing ( this the most polite word we can use )
There is supposedly a general legal principle in Portugal “o Estado não pode beneficiar da sua própria inércia” (the State cannot benefit from its own inertia/delay) which could be used to argue for PR / citizenship clock start 90 days after application.
Whether such argument is successful would be up to the judges.
Since tomorrow is a holiday, are we assuming today is the last day the president could realistically veto the new law? Any rumors out of Portugal? Our 5 years is up in early June and I am beside myself about missing the deadline by such a short window.
It’s not uncommon for the President to sign bills at the weekend - he could do it on Sunday
It is most likely that he’s already signed it and gave it to his secretary. The secretary only waits until the last moment to release it. The decision was already made but it will be published later…
Unfortunately, there are a lot of cases on Diario da Republica showing Portuguese courts don’t really take the view that “AIMA missed 90 days, so you’re approved.” They tend to say: “AIMA has to move the file, but delay by itself doesn’t magically start the clock.” ![]()

Very helpful, thank you. I guess it is what it is at this point, but I am trying to determine if there is any realistic chance the president actually vetoes this weekend, or if the fact that he would be waiting to the last minute indicates it is very unlikely to happen.

On a separate chat, one of the lawyers observes that the previous President used a political veto on more than 40 occasions, including Nationality Law amendments in 2020. So it’s not an outlandish idea. However, Seguro is perhaps less likely to use the veto given that the bill was passed by a large majority and the votes are likely there for a veto to be overridden.
As others have said earlier in this thread, if Seguro had issues with the new law he likely would have referred to the TC rather than using the nuclear veto option.
He came in saying he wanted more cordial relationships in politics. Nuking one of the first bills to come to him doesn’t sound like his style. But we shall see!

I see that the President has promulgated the new law. My understanding is that it will only become law after: (a) being published in the gazette; and (b) the notice will indicate if it is effective immediately, the following day after publication, or some time period thereafter (with five days being the most common/default). Does anyone have any information as to whether this new law will be published on Monday and the timeframe to take effect?
