I believe I read that it really was about lawyer persistence and connections, up until the last year or two when SEF committed to processing applications in chronological order. Crazy to think about!

Yes. Weāre confused because until now, we havenāt heard of anyone with a submission date in December 2021 getting the opportunity to do their biometrics

Ok so hereās the full picture: I invested in a non real estate fund (MedCapital). I originally applied in early 2021 but didnāt submit the last of the supporting documents until Dec 2021, which is when I assumed my application is officially lodged. (Where I come from any application is not considered submitted until the last document is sent in.) I received pre-approval in July 2022 and my biometrics appointment is March 2023.
Hope this helps everyone. I know it has been a very frustrating process.
When I see my lawyer next week I can find out more and will share more details here on any additional tips and tricks.

I have seen you discuss this before. Is there a detailed article or analysis where we can learn about this topic? There seems to be very little information available online. I submitted in December 2022, wondering if this route is open - Iām not looking to move immediately, but Iām assuming Iāll be waiting till 2025 for the actual resident card, so would want to move early in 2024 if possible.

If you are wondering about the āpendingā status of the application and moving to Portugal under āirregular residentā status, this is what my attorney conveyed to me. I moved to Portugal myself about 6 months after pre-approval and before my biometrics (I did biometrics in January 2023, and still donāt have my residency card - what a surprise!). We stayed in Portugal well past our tourist visa, and had no issues with SEF, either whilst there or when we were leaving for the U.S. for a āhomecomingā (more like tax preparation, etc.). Once you receive your āpendingā status, you can request a confirmation from your lawyer with your case number. Generally this should suffice.
Unfortunately, I do not have a link to any official directives clarifying this matter. Next time I will chat with my lawyer, I would ask her for the section of the immigration code that addresses this issue.

I think your application date must be the earlier date. That is the only way pre-approval in mid-2022, or biometrics in early 2023, makes any sense.
What a difference a year makes! You might still be waiting for pre approval if your app was submitted in December.
