Harland Poston D2 scheme

Hi all,
has anyone invested into the package that Harland Poston is offering to get the D2 visa? they are proposing to start a company that will have certain income throughout the 5 years period. A lot of advise has been shared that the D2 is meant for staying in Portugal permanently but what a big law firm advised me is that as long as I visit Portugal every six months, then the D2 will continue to be renewed without issues. what do you think of this?

I’m sorry you are totally wrong. The D2 insists you should not be out of country for more than 6 months at a time, unless you have a good reason. These reasons include, business, family commitments, and health issues. I am in this program and my lawyers are Portugals largest immigration specialists. I saw all this misguided nonsense before I applied and looked into it in great detail and spoke to 4 lawyers of which 3 told me this and one inexperienced firm said the same as you. The difference is the regulations for D7, where you must be tax resident, and thus be in country for over 180 days. The D2 is seen as an entrepreneurial visa to encourage foreign business owners to open offices in Portugal.

This seems kind of up to discretion of the AIMA agent you get?

I’m all for legal loopholes that avoid the quagmire of GV but it seems this might be even more of a quagmire.

You don’t have to be physically resident to be tax resident - plenty of GV holders signed up for NHR and tax residency with just a lease and 1 week / year in Portugal.
