We have moved from CA to Portugal (well, permanently), and our accountant took over the ā€œtax addressā€ in the U.S. He said unequivocally that we can just stop ā€œclaimingā€ CA residence. If you leave CA, it should save you good 10 to 12% of ā€œsquandering your money on useless programmesā€. Of course, you are still liable for the Fed plus SS plus Medicare… Got to love your taxman!

I was offline for a couple of weeks and have been trying to figure out what happened with the bill - and went through most of the thread but was unable to find a good article to tell me what the current status is - has that bill been voted on? Is there a final version that we can read and understand of the bill? If not, when is that expected?

Also, I saw some articles that suggest that the KEY feature of the golden visa (7 day stay) is definitely now gone and retroactively to all applications? What is the point of this visa if that is the case, even if the bill does not make the other changes orginally contemplated?

In brief:

16th Feb: first announcements about end of GV

3rd Mar: draft legislation published: applications after 16th Feb to be rejected, all else grandfathered except new real estate lease provisions on renewals

30th Mar: new announcements: everyone to be converted into a normal permit, either on first issuance or renewal. Implies (though not quite clear) 7/14 day minimum stay is replaced by usual X month rules

As of now: No new draft legislation has yet emerged. Expected to go to parliament this or next week. Once legislation emerges, expect more discussion about whether key provisions are constitutional. President’s position on this unknown. May refer to Constitutional Court.

Yes, if the common understanding of what the government proposes is correct, and if it all goes through, then it makes the GV pointless. But a lot of road to travel before we get to that point.

Thanks for the clear update - I thought there was supposed to be debate last week of March on this, so looks like some of that did not happen yet… And things have actually gotten worse with the residence requirement being a new target :slight_smile:

Other thing to catch you up on is that with the second draft has also come a lot of opposition from interested quarters. There’s a petition pinned here which is worth sharing to continue adding to that sentiment. There’s also been some initial coordination and thinking around viability of legal challenges if required.

SEF is being dissolved and a new agency will be created within 6 months. Hoping this will speed things up!

Ok, here is a poll to assess your interpretation of the articles.

  • Portugal is welcoming of all types of immigrants.
  • Government is hypocrypitical for condeming the number of GV applications, while admitting 10 times that amount in one month of other visa types.

I have just received a response from my lawyer regarding how probable it would be that the proposed ā€œMais Habitaçãoā€ would pass, terminating or substantially altering the GV process. Her response was that, as a contributing member to the Commission to study the effects of ending GV, she seriously doubts this programme would end anytime soon:

ā€œā€¦ the proposal […] is unconstitutional and our president already said that will not approve the said proposalā€. ā€œTherefore, everything is as it was, and I believe it will continue like that for a long time!ā€

It might not be enough to calm everyone’s jitters, but it should give you another point of view from the local perspective.

The ARI approval records are going to be coming every month for a while, given how much applications skyrocketed in 2021 and how long they are taking to process…

I also question IMI Daily’s understanding of the situation and process. Their chart says ā€œapplicants by monthā€ but a) the numbers seem very low, b) they show no drop in application from Jan-Jun 2022, c) I don’t think SEF even publishes application data, only approvals, and d) the source they claim doesnt contain the data in the chart.
