Artigo 43.º

Norma revogatória em matéria de autorizações de residência para investimento
São revogados a alínea d) do n.º 1 e os n.ºs 2 a 4 do artigo 3.º, o artigo 90.º-A e a alínea r) do n.º 1 do artigo 122.º da Lei n.º 23/2007, de 4 de julho, na sua redação atual.

Artigo 44.º

Autorizações de residência para atividade de investimento
1 - Não são admitidos novos pedidos de concessão de autorização de residência para atividade de investimento, previstos no artigo 90.º-A da Lei n.º 23/2007, de 4 de julho, a partir da data da entrada em vigor da presente lei.
2 - O disposto no número anterior não prejudica a possibilidade de renovação das autorizações de residência para atividade de investimento quando essas autorizações tenham sido concedidas ao abrigo do regime legal aplicável até à data da entrada em vigor da presente lei.
3 - O disposto no número anterior é igualmente aplicável à concessão ou renovação de autorizações de residência para reagrupamento familiar previstas no artigo 98.º da Lei n.º 23/2007, de 4 de julho
4 - O disposto no n.º 2 é ainda aplicável aos cidadãos titulares de autorização de residência para atividade de investimento e seus familiares que cumpram os requisitos previstos no artigo 80.º da Lei n.º 23/2007, de 4 de julho, na sua redação atual, e pretendam requerer a concessão de uma autorização de residência para atividade de investimento permanente, excecionando a este regime o previsto na alínea b) do n.º 2 e nos n.ºs 3 e 4 do artigo 85.º do mesmo diploma.
5 - Nos casos previstos nos números anteriores, a renovação determina a conversão da autorização de residência numa autorização de residência para imigrantes empreendedores, nos termos do n.º 4 do artigo 89.º da Lei n.º 23/2007, de 4 de julho, na sua redação atual, devendo os seus titulares cumprir o prazo mínimo de permanência de sete dias, seguidos ou interpolados, no 1.º ano e de catorze dias, seguidos ou interpolados, nos subsequentes períodos de dois anos.

Artigo 45.º

Pedidos de autorização de residência para atividade de investimento pendentes
1 - Mantêm-se válidos os pedidos de concessão e de renovação de autorização de residência para atividade de investimento solicitados ao abrigo do disposto nos n.ºs 1 e 2 do artigo 90.º-A da Lei n.º 23/2007, de 4 de julho, que se encontrem a aguardar decisão junto das entidades competentes na data de entrada em vigor da presente lei.
2 - O disposto no número anterior é ainda aplicável aos pedidos que se encontrem pendentes de procedimentos de controlo prévio nas Câmaras Municipais, na data da entrada em vigor da presente lei.
3 - Aos pedidos referidos nos números anteriores aplica-se, com as necessárias adaptações, o previsto no n.º 5 do artigo 44.º.
4 - Para efeitos do disposto no número anterior, devem as entidades competentes verificar a adequação do investimento ao respetivo projeto empreendedor.
5 - São competentes para a verificação da adequação do investimento ao respetivo projeto empreendedor, consoante a matéria:
a) A Agência para o Investimento e Comércio Externo de Portugal, E. P. E;
b) O Banco de Fomento;
c) A Agência para a Competitividade e Inovação, I. P.;
d) A Agência Nacional de Inovação (ANI);
e) O Gabinete de Estratégia, Planeamento e Avaliação Culturais (GEPAC);
f) Outras que se revelem adequadas em razão da matéria.

Artigo 46.º

Pedidos de autorização de residência para atividade de investimento ou apoio à produção artística, recuperação ou manutenção do património cultural nacional
1 - São admitidos os novos pedidos de autorização de residência relativos a investimentos ou apoios à produção artística, recuperação ou manutenção do património cultural nacional sobre os quais tenha sido emitida, previamente à entrada em vigor da presente lei, declaração pelo GEPAC, nos termos da alínea b) do n.º 8 do artigo 65.º-D do Decreto Regulamentar n.º 84/2007, de 5 de novembro, na sua redação atual.
2 - Aos pedidos referidos no número anterior aplica-se, com as necessárias adaptações, o previsto no n.º 5 do artigo 44.º.

3 - The provisions of the previous number are also applicable to the granting or renewal of residence permits for family reunification foreseen in article 98 of Law 23/2007, of 4th July
4 - The provisions of point 2 are also applicable to citizens holding a residence permit for investment activity and their family members who meet the requirements foreseen in article 80 of Law 23/2007, of 4th July, in its current wording, and wish to apply for the granting of a residence permit for permanent investment activity, with the exception of the regime foreseen in paragraph b) of point 2 and in points 3 and 4 of article 85 of the same law.
5 - In the cases foreseen in the previous numbers, the renewal determines the conversion of the residence permit into a residence permit for entrepreneurial immigrants, in the terms of no. 4 of article 89 of Law no. 23/2007, of July 4th, in its current wording, and its holders must comply with a minimum period of stay of seven days, consecutive or interpolated, in the first year and fourteen days, consecutive or interpolated, in the subsequent two-year periods.

Article 45

Pending applications for residence permits for investment activity
1 - Requests for the concession and renewal of residence permits for investment activities requested under the provisions of paragraphs 1 and 2 of article 90-A of Law 23/2007, of 4th July, and which are awaiting a decision from the competent authorities on the date on which this law comes into force, remain valid.
2 - The provisions of the previous paragraph are also applicable to requests that are pending procedures of prior control in the Municipalities, on the date of entry into force of this law.
3 - To the requests referred to in the preceding paragraphs are applied, with the necessary adaptations, the provisions of paragraph 5 of Article 44.
4 - For the purposes of the preceding paragraph, the competent entities must verify the adequacy of the investment to the respective entrepreneurial project.
5 - The following are competent to verify the adequacy of the investment to the respective entrepreneurial project, depending on the subject
a) The Agência para o Investimento e Comércio Externo de Portugal, E. P. E;
b) Banco de Fomento;
c) The Agency for Competitiveness and Innovation, I. P. E;
d) The National Innovation Agency (ANI);
e) The Office of Cultural Strategy, Planning and Assessment (GEPAC);
f) Others that prove appropriate due to the subject matter.

Article 46

Requests for residence permits for investment activities or support for artistic production, the recovery or maintenance of national cultural heritage
1 - New requests for residence permits for investments or support for artistic production, recuperation or maintenance of national cultural heritage, for which a declaration has been issued by GEPAC, prior to the entry into force of this law, under the terms of paragraph b) of no. 8 of article 65-D of Regulatory Decree no. 84/2007, of 5 November, in its current wording, will be admitted.
2 - To the requests referred to in the preceding paragraph shall apply, with the necessary adaptations, the provisions of paragraph 5 of Article 44.

Here is our quick summary. The new law follows common sense by not applying retroactively and keeping the 7-day-per-year rule. People who have applied for a GV but have not yet received it are protected. Although the law allows for conversion to a D2 visa, there is no requirement to live in the country for 182 days before applying. The new visa will have the same flexibility as the ARI visa, but it will be called a special D2 visa. The law will go into effect on the date it is published in the official journal.

Article 45 seems to impose new requirement to verify “the adequacy of the investment to the respective entrepreneurial project.” I wonder what impact that will have on the existing applications and whether that means more paperwork and delays… It seems to only apply to the applications currently in progress.

Overall the proposed law seems very accepted. Had a chat with my lawyer and she is also very comfortable

As someone with a pending application, I’m slightly unnerved by 45(5) though

Seems fairly promising!

I think this is a partial win at this stage. A lot of it seems to address the concerns we’ve had. But exactly how GVs convert into D2s is unclear to me - in particular whether there is any real assessment of whether the underlying investment is ‘entrepreneurial’. Perhaps it’s designed to be a fudge. But I’ll keep the champagne on ice for now until more clarity emerges.

But it certainly seems the Government has taken on board the barrage of criticism they got from constitutional lawyers; perhaps this is enough to keep it out of the Constitutional Court.

This part confuses me because the initial GV card was already changed to 2 years. My lawyers told me this means the stay requirement is 14 days for all periods, including the initial one.

If those 14 days happens to fall in the 2nd year of the initial card, it seems reading the law literally they could deny you on the technicality that you didn’t spend 7 days in the first year?

I think this is a drafting error, needs to be cleaned up as the bill goes through parliament

I don’t usually make recommendations but if you are trying to get in a last minute application for Portugal golden visa, you should consider Prime legal, or Madalena Monteiro. There may be a few others but I dont know who else was involved. These lawyers are the ones fighting for us and I think you would be in very good hands. (I am sure they also do other areas of law also.)

Based on my reading, it seems that individual government agencies will be determining the relevance of specific applications. For example: GEPAC certifying our cultural heritage donation.
