Survey on Nationality Law impact on Portugal Golden Visa

Hi everyone! I’m drafting a survey that I plan to send out to our email list this week. The goal is to map out what the potential impact would be if the Nationality Law amendments are implemented as proposed—and hopefully get some useful data for trying to influence Portuguese politicians to more seriously consider the indirect impact the changes would have on the GV program.

This version of the survey is definitely still a draft—so I’d love to get everyone’s feedback on the questions, the available responses, the explanations, typos, etc.

It’s only two pages long, and which questions you are asked depend on whether you have applied for the Golden Visa or if you are still considering/in the process of applying.

The survey looks comprehensive. It could help us if some questions can be added to address that

  1. we should be afforded “the rules applicable at the time of committing the investment originally”, and
  2. the long wait time for getting from the initial apporval and payment to SEF/AIMA till the receipt of the first resident permit card.

In addition to the current set of questions articulating the negative consequences of such nationality law changes.

Hi Thomas - couple small things:

  • “4. Jus soli tightened for newborns with foreign parents” >> not sure everybody knows what that means
  • Another potential action GV investors might take is suing PT to get what they originally signed up for

Completed and added suggested questions to the effect of: To what degree did your perception/reliance upon Portugal as having a stable legal environment and commitment to the program influence your decision to invest?

Thanks for doing this @tkrunning! Just a suggestion that if they are adamant about the Nationality Law changes, maybe it would be productive to request that for ARI Permanent Residency they start counting the 5 years from the date of application instead of the date of approval. Maybe it could be a consolation prize the right wing pro business parties wouldn’t be as opposed to :woman_shrugging::crossed_fingers:

My understanding is that is limited by EU law?

The amount of time(approx 3 months for the UK) it takes to gather all the documents from the resident’s Government departments, get them validated and then translated before GV application plus the investment lead time mean people are committing way before the GV application date so any protections should include that additional lead time IMO.
