If the law deemed unconstitutional by the Constitutional Court, it can not be overridden. It would need to be amended to pass.
Or even if they force pass it, a lawsuit going up to the court could get it struck down.
This is exactly where I am. If the US wasn’t such a cluster right now I would just pull out immediately. Not sure what I’m bothering for anymore.
Indeed. I filed a lawsuit the day after the election, and I’m mostly convinced that it pulled me from the biometrics queue (10/19/22 investment) and left me in a legal limbo also known as purgatory. The hotel I invested in was built and opened last month and I haven’t even gotten fingerprinted!

As anticipated, the Proposed Amendment to the Portuguese Nationality Law was approved yesterday evening by the Portuguese Parliament.
The majority approved seven years of legal residence for EU and CPLP nationals, and 10 years for other nationals. The Law has not yet come into force as it still needs to be submitted to the President of the Republic, who may:
a) Promulgate the Law;
b) Veto it and return it to Parliament for revision; or
c) Refer it to the Constitutional Court for a preventive review should any constitutional concerns arise.
We will continue to monitor developments closely, particularly any decisions or public statements by the President of the Republic.
At this stage, it is recommended that you do not take any irreversible steps based on media headlines. Until the Presidential phase (and eventual Court review) is complete, and the law is published, the current legal framework remains the status quo.
We expect further developments in the coming week and will keep you updated.

My Baby was born in Ireland and I have a Portuguese citizenship and we have applied for his citizenship as a single parent through a lawyer, Unfortunately he told us it will take 4 months to get his birth registered and now lately he doesn’t answer our call.
Would you be able to let me know when will his birth get registered. I have messaged the registrar but there is no reply from them.

I am unable to answer you when your child will get the birth certificate.
As I can see the complication is that your child is born outside of Portugal which is required longer time in the verification process.
I have zero knowledge about child’s naturalisation via a naturalised portuguese father. Only thing I have in mind now is that it seems to me that it takes 3-6 months a child who is born in Portugal by naturalised parents to get the certificate. Therefore, I would say at least 9-12 months for a child born outside Portugal. Also, do expect that lawyers do not answer emails/calls. It is what it is unfortunately!
You could follow the PT nationality forums and facebook groups for this thing. I believe you have applied through article 1.C and I believe as per tracking information available on the forums they are currently analysing Apr/May 2025 applicants and your baby’s turn might be up in a few months. The lawyer is ghosting you at the moment, this is super common in Portugal as they have no answer for you. Unless the IRN raises any concerns, the nationality shall be granted without any lawyer intervention. You just have to track the application online once a month and that’s it..

Yes Art1.C. Yes they ghost alot and told me it will get registered in October. I fought and got the access code. He has submitted the document as a single parent hope it wont be any more issue. Thank you for the heads up.
