Awaiting Final Approval (Stage 4)

Sorry for the multiple messages. Was your investments real estate oriented. It will be good to know if there are any changes to the way real estate investments are being treated for approvals. Specially for people who applied before any changes in the law. Thanks :pray:

Sorry for the ambiguity.
I split my investment into 2 funds, one was into RE and was a pure VC fund.
So yes they are accepting funds with RE investments for those who applied before the change of the law last year.

Good news everyone! President signed the law for citizenship to start on the date of submission rather than the date the visa was granted. It comes into law after being published in the gazette, which is a formality but the next step.

Yes, the president has signed the law.
The manifestação de interesse doesn’t have an exact equivalent in the GV process, so how the start date will be calculated/calibrated has been the subject of speculation on another thread: Wait time now counts toward 5 year residency? - #378 by sj-to-pt.

I know we’re discussing this elsewhere but to add to your point, it’s interesting to note that the judge in the sentencing document issued by the court following my AIMA summons says explicitly that “the expression of interest was made on 16 November 2021” (my bolding). The use of this phrase by the judge gives me hope.

@Onward @kipper_tucking0a The last thing I heard is that the constitutional court had ruled that the amended nationality law was indeed constitutional, and so the next stage was for the President to sign the law, and this was expected to be done quickly. Apologies if I missed the announcement that the President has now signed the law, but if there has been some public announcement about this I would certainly appreciate a link. Apologies if I’ve misunderstood or overlooked anything.

Just found this article saying that “the President … promulgated the law on February 24 after the Portuguese Constitutional Court ruled it was constitutional”.

The article concludes with “Nevertheless, the law, approved in a final vote, is awaiting presidential ratification and will come into force one month after its publication in the official state gazette. Until then, the current law applies”.

The law now needs to be published in the Diario, which should be in the next few days, and will take effect on the 1st of the month following publication. So that is likely to be 1st April.

Perfect, thank you! So it is expected that on 1st April these amendments will become the new law! I’m really looking forward to seeing how it gets translated into the various practical aspects, particularly the exact date to be regarded as the date of initial application/expression of interest/etc, the documentary proof that will be required, the 7/14 day stay requirements, and presumably confirmation that we will also need to supply either the eventual confirmation of final approval or the actual residence permits upon application for citizenship.

As well as the revisions to the Law just passed, within 90 days the Government is required to amend the Nationality regulations, which may shed some additional light on the detail. AIMA may also, in time, update and reissue the SEF manual, which is a public document. But we may only know all the answers when people apply to naturalise using the backdating clause, possibly with the involvement of the courts.
