Applied December 23 , got request for documents mid November and got preapproved on November 21st with my wife knowing that her application date was February 10th 2022. My biometric appointment set for January 30th
My concern is about my 3 kids as there is no movement there and for sure they will have now a different date for biometric appointments which is very unpractical socially for the minors as we need to be with them , so extra trips !
I asked the lawyers to try to do something about it not sure if they will be able to

I would absolutely get your lawyer to petition to get the children to have their biometrics at the same time, given they canāt travel alone for them. Sometimes works, sometimes doesnāt. Didnāt work when we tried to get my baby done at the same time as me. Did work when my baby was later invited for her biometrics and my husband wasnāt (heād missed his first appointment). Our lawyer managed to get SEF to agree he could do his at the same time, as the baby couldnāt travel alone.

I spoke to a different lawyer regarding a lawsuit. This law firm shared the same opinion as my current lawyer, a lawsuit to speed up preapproval would be fruitless, they suggest lawsuits for those that have already done biometrics and waiting forever for their residency cards.
This lawyer also told me the AIMA is working on Sept 2022. No progress in my case though.
On that note, the lawyer made mention that there was another extension announced. Iām not sure if sheās referring to this one? Since Iāll be overstaying as a visitorā¦

On what basis is the lawsuit for pre-approval fruitless according to the lawyer? Many people have won those already. I think certain lawyers donāt have experience with this and so they advise against it, to the detriment of their clients.

No, unfortunately they are in process of approval of applications with biometric appointments completed in Sept 2022. They are nowhere near there with pre-approvals of applications submitted in 2022.
The law you linked is referring to costs and fees relating to visas, I donāt see anything in there about extending validity of visas. Although my Portuguese is not quite to the level of reading legal documents. If anyone does have a link to the despacho mentioned, though, please share it.

I spoke to my lawyer yesterday, and he has not seen any preapprovals come through his office lately.
Prepared myself mentally by Dec beginning that the holiday season is going to be a full stop for new approvals. Relax, go enjoy the season and letās hope for the best from Jan 1st week onwards.
Hi everyone, has anyoneās lawyers told them that they can stay in portugal as long as they like while their pre-approval is pending? As long as they fly in and out of the country to get to non-eu countries and donāt overstay in other european countries? My lawyer just casually told me the other day when I had been shifting life around to figure out this long pre-approval time. Iām shocked as was previously told by them and other lawyers that I cannot stay in portugal more than the visitor time of 3 months every 6 months without getting my pre-approval. Any insights would be much appreciated.
If you search this forum, youāll find answers vary on how long you can stay in PT whilst in pre-approval limbo. Probably because people have had very different experiences! Iāve written before here about how Germany was a stickler for our passports/stamps even when travelling intra-Schengen, whereas France, Austria and Switzerland didnāt even have us stop for a passport check. Itās kind of a lotto, Iām afraid.
That said, Iām wondering if Portugal has the equivalent of the Spain and France long-stay visitor visas - and (a) whether people have had success with it, (b) whether you can be on this visa whilst waiting for your Golden Visa. Some have said having multiple visas on the go can be problematic.

Yes, that is what my lawyer told me. And I contacted a different law firm for a second opinion and they said the same thing. Stay in Portugal only, fly in and out of Portugal to non-eu countries. And both lawyers are using that āextended until June 2024ā to apply to my situation, as well.

No, but woth the new law its less frustrating to wait.
