Hello,
I am sure this topic has been covered elsewhere, if so please tag me. Thanks in advance.
I am a brit, eligible for PR, past the 5 years and have all the documents and requirements. However they issued my 3 year D7 renewal this year and it expires 2029. Therefore I am not an urgent case. However I have a daughter and an elderly frail mother and a work in the UK and need to travel to see them, however it would be hard to obtain ‘an urgent case’ proof. Under current scenarios it looks like I am more likely to get a PR appointment in a few years upon the current card expires. No good, not my original 5 year plan and very unfair since rules changed and I have been physically here since 2021! Therefore I have researched this and understand if I pay a lawyer I can get the following service. Is this true and can anyone recommend it or a firm? Until I have some certainty of this ( and understand the rules are the rules and it’s not one big scam and more changes ) I refuse to invest further my hard earned cash in Portugal and I will leave. If I know I can obtain PR sooner it enables me to make some life plans that integrate Portugal into my life. Why should I otherwise? That would be foolish.
If the following is true, has anyone done it, is doing it or knows the timeframes of success ?
Another question does anyone know about the Deviation Request while I am waiting? Because the law actually allows for exceptions to the time-away rules (A formal notification to AIMA detailing my professional work obligations.)
Under Portuguese immigration law (Article 85 of Law 23/2007), temporary residents are generally expected not to be away for more than 6 consecutive months or 8 non-consecutive months. However, the law explicitly waives this penalty if you can prove your absences are due to professional, business, or force majeure reasons. I am company owner, with a busy international career, I am not retired yet and I need to travel and work abroad, I cannot put my life on hold in Portugal anymore unable to do this - it’s a long time to sacrifice my career and profession that is based outside Portugal.
