The 90 day validity

Asking the amazing forum here

My attorney have yet not submitted my application, but im concerned about document validity. How exactly is document validity calculated? Is it true that as long as at the time of submission, documents are within 90 days, it is fine until the time of bio appointment, no matter how long the wait time may be?

Also, if family can only be uploaded after main applicant is checked, does that mean for family member it would be a different 90 day validity period?

My lawyer have expressed there is nothing to worry about as long as submission is within 90 days, but reading here I am not too sure anymore.

Has the digital payment system been fixed?

From my understanding, the criminal background record validity should start from the date of issue, rather than the day it is uploaded onto AIMA portal. If that is the case, expiration date should be 91 days from the date of issue.

Right. So let’s say I submit before the expiration, will I need refreshed criminal record and apostille for the biometric appt?

There is only one way to find out. But after you submit the refreshed documents, don’t keep refreshing them voluntarily. Instead, wait for AIMA to ask, and then complain everywhere you can (e.g. the Yellow Book) and go talk to the press.

After all, AIMA made a big song and dance about it, telling hundreds of lawyers publicly that as long as applicants submit refreshed documents now, we would not need to do so again either before or after the biometric appointments.

My personal opinion is that if the biometric appointment doesn’t happen for a LONG time (say, 6 or 12 months), AIMA will just ask again. Bureaucracy is like a perpetual machine that sustains itself. But your guess is as good as mine.

interesting - this is helpful!

My case is that I have not submitted yet, so I do not have any docs that need to be refreshed yet. Everything will be “fresh”, its just i am concerned that they will cause problems down the road when I may be in a different country from now and will not be able to get the “refreshed” apostilles

Oh I thought you were a 2022 or 2023 applicant. For new 2025 applicants, just roll with the punches. Don’t pay good money every 90 days just to keep documents “fresh”—treat yourself to a nice Thai massage instead

Haha okay. well jus wanted to make sure i understand what is coming next so i can be better prepped, especially with big moves coming up.

My lawyer said nothing to worry about but some posts in the forum makes me feel a bit concerned.

At least in the previous AIMA process, by the time your biometrics rolled around (for us almost 2 years after applying) yes you had to refresh some of your docs.

Maybe in the “new AIMA process” this won’t be necessary. But I see people being just as ignored by AIMA in the new process as the old one. So chances are months/years will still go by before your Bios and you’ll need to get docs refreshed.

In the previous SEF/AIMA process which I went through, the initial ARI application need to be submitted with valid documents at time of submission (e.g. within 3 months of criminal record issuance). I waited 1 year+ to attend the biometric appointment and a refreshed full set of valid documents needs to be presentted at the appointment. Upon completion of the appointment, a confirmation letter (Recibo comprovativo de pedido de ArtÂş 90/A - Atividade de Investimento - ConcessĂŁo) will be issued and will state if there is any missing document. The missing documents can be submitted within 20 days after the appointment, which can be extended at request. In my case, the social security declaration was missing at the appointment and my lawyer submitted 2 week after.
In the era of “new AIMA process”, refreshed documents seems still needed, perhaps before biometric appointment scheduling.

thank you thank you! it was quite a horrible experience to go through! :frowning:

thank you thank you!
