Wait time now counts toward 5 year residency?

Having NIF alone does not make you tax resident. You need NIF even before purchasing the investment, many online providers will get it for you for a small fee (about 100 euro)

The need to “prove the existence of an effective link to the national community” is no longer in the Nationality Act - it was removed in 2006. I wrote about this last year

FWIW there was no request /requirement for proof of legal residence status / visa when I signed my long lease in 2021. I only had an automatic schengen visa at the time, no problem.

As mentioned the law has been amended, it is more precise now. Yes in the past there was the phrase of “sufficient ties to Portugal” which raised concerns about what it really means. When I first started this journey in 2017, I was told that in the future I might need to look for additional ties, but with changes that took place later on, there was no such need. I checked this specifically with lawyers. Please feel free to check this with your lawyers as well.

I myself applied last September along with few friends. The process is not really that complicated with regards to what is being asked. If you are a GV investor, bank account and NIF should be there; the whole point of the program is investing into Portugal, so I can’t really imagine how you would do that without a NIF + bank account.

The numero de utente could be gathered online during Covid times (I have written about it in one entry, if that option is no longer available I would check it with the lawyers. I got mine free via email which took 3-4 months, my lawyers told me that they could do it on behalf for a small fee)

To wrap up, I would not make this process any more complicated than what it is. It is not the fastest system - “We all know it” but with the recent changes, once you pass the 5 year mark and have the language certificate, criminal checks and birth certificate in place, the rest is more about collecting the other documentation…

You can do a quick online check, I think in year 2022, 98.9% of all citizenship applications were approved. This means that almost anyone who applied got the citizenship - there would be always that 1% with some issues. (In fact I expect that to be higher)

Last but not least when you reach the stage for citizenship application, apply online (either by yourself or through your lawyer / solicitor) Do NOT apply via post. I will write a separate entry about this. Otherwise you can wait for a year before you application is even registered in the system…

Actually, Portuguese GV precedes Spanish one. In fact, Spaniards have “modelled” their GV after Portuguese. :slight_smile:

This is certainly a good news in all means. However, the current processing time of Portuguese nationality through ARI route has been stretched to 3 years now. Last year what I was informed of was 2. So the amount of waiting time we could save with this new law, might go into the nationality processing time after residency term is fulfilled.

When you submitted, you had to pay the application fee for it to be officially submitted. I would think that will end up as the date as it’s a concrete way to say your package was sent? My attorney sent the package and about 2-3 days later I was to pay the fees on line. I believe she has a way to see were they are in the process as she just told me that they have not completed the last week of December 2021. My dependents applications were submitted in February 2022 since they did not have the December 31st dead line for the investment.

Does ARI nationality process times really take 2-3 years?

Dont ARI applicants just fall under article 6.1 (naturalization for 5yr resident)? I believe article 6.1 takes about a yr / year and a half?

Yes, ARI falls under article 6.1 absolutely. I was meant to say the current processing time for article 6.1 has prolonged to 2 to 3 years now, ARI or no. They now have a huge backlog of nationality requests to clear off. Before Covid there was a good chance to gain PT nationality within 2 years after submission, but things have gone downhill ever since…

I think most lawyers gauge AIMA progress by their own clients’ progress. One of them having insider access would be big news…

Hi, click on the “Full Text” arrow at the bottom of http://www.dgsi.pt/jsta.nsf/35fbbbf22e1bb1e680256f8e003ea931/0184459ed0922987802583150034db3d and you will see it is about “residência temporária, para efeitos de exercício de uma actividade de investimento” or in English “temporary residence permit, for the purposes of carrying out an investment activity”. That is the GV.

I don’t think GV is the only mode of temporary residence permit. This case could have pertained to some other option, right?

Golden Visa is the common name, the official name is ARI: “Autorização de Residência para Investimento” meaning Authorization of Residence for Investment.

So “temporary residence permit, for the purposes of carrying out an investment activity” is referring to the ARI or GV.
