@InvestVG-PT , did they not ask for a valid visa when checking in at your Brazil airport?

Brazilians do not need a visa to enter the European Union.

My parents have cards expired in 2021, and yes, if only entry and exit from PT, the cards are fine, just taken a lot more time as the border police needs to call their supervisers to varify the “new laws regards to auto extension of expiry dates” and we are from China, not CPLP states

We go in and out constantly with an expired permit and have been doing so for years. BUT wife has a US passport and I have a Schengen visa. All they verify is that one has not been in Schengen (excluding PT which is not counted) for more than 90/180. I just keep a spreadsheet and boarding cards handy.

What about when the EES goes into effect? As Portuguese residents we aren’t allowed to get one, but we won’t be allowed to board a flight without either a valid residence card or the EES.

You mean ETIAS? If your residency is expired you probably can get ETIAS - at least for countries other than Portugal.

My understanding is the first iteration is the EES. The ETIAS is not available to EU residents. Beyond that, you can’t enter other EU countries with an expired residency card if you’re a Portuguese resident and have exceeded the 90 days allowable in Schengen after the residence card expires.

EES is for visa waiver countries. If you keep a count of non Portugal days and stick to the 90/180 rule you will be Ok but you will have to enter and exit PT through a non Schengen country. UK is usually cheapest but you can holiday in Morocco!

With luck your card will be renewed before EES comes into effect.

My point is, while Portugal border authorities may allow one to enter on an expired Residence Permit, other Schengen countries will not unless you have a passport that allows visa-free access to Portugal/Schengen, or of course, you have some other Schengen visa (e.g. tourist visa). In fact, to the best of my knowledge, the airline will not even allow you to board a flight to Portugal unless you can show them a valid entry visa, and it is highly unlikely they will accept an expired card (notwithstanding extensions granted by Portugal), especially if the flight is not direct to Portugal.

You do not have to worry so long as you do not spend more than 90/180 days in Schengen countries other than Portugal.

Etias is a complication that has not started yet but as an American you are subject to EES which will count days from your entry into the Schengen zone and your exit and calculate the 90/180 rule (till now there is no central system and border police must rely on passport stamps).

EES is not supposed to be applied to those with long stay visas but who knows what they will do with expired residence permits. Therefore it will then be safest to enter and exit EU from Portugal where they should not enter you into EES and then make sure you keep entry and exit proofs into and from other Schengen countries to make sure you stick to the 90/180 rule.

What’s your thinking on the ETIAS situation?

My mistake EES is for all external border crossings of all non EU nationals (nationals or lawful residents are not required to do this). It counts days in Schengen so to be clear of this best to go into and out of Schengen through Portugal where they should not enter you into EES.

Etias is just a pre authorization for those from visa waiver countries, same as what the US has. Those with ETIAS will still be subject to EES.

For visa waiver people you may need an ETIAS if your residence permit has expired - just as I keep a Schengen visa in my pocket.

But entry and exit to Schengen through Portugal may minimize problems as you will not be subject to EES.

If you search the forum for “Emirates” , you will see examples of people with the “wrong” type of passport who have entered on an expired resident permit (due to extension by a Portuguese authorities) - you can get pre clearance to board. Understanding is Emirates and Turkish do this (not sure of other airlines ). But yes it will only work for flights directly from outside EU to Portugal , as it is only extended for Portugal and not Schengen countries. You would need a Schengen visa / the “right” passport to be able to go to other countries.

We are awaiting renewal appointments. Can anyone confirm what the AIMA renewal fee is (for the property investment route)? Are they converting to a D2 visa with the lower fee?

About 4K each plus legal fees. My lawyer has said they will refund any diff but they have pay as soon as appt is made.
