This has been exquisitely well-timed and effectively received by the TC. It delivered the highest-quality legal arguments against the law at the last possible moment, providing the TC with the strong legal and factual evidence necessary to solidify the veto on the basis of Legal Confidence and Equality.

" In a legal submission known as Amicus Curiae, the 15 investors – “representing thousands of citizens in the same circumstances” – argue that the proposed changes betray the trust they put in Portugal (as well as the money) when they took out golden visas.

“There is a significant change in the rules, extending time limits and implying new burdens, betraying our trust in the word and good faith of the (Portuguese) state,” says the text.

Expresso explains that “the 15 signatories feel defrauded with the legal changes which don’t simply increase from five to 10 years the time necessary for legal residence in this country before being able to request nationality but do away with taking into account the time between the request and the issuance of the card, which, given the delays at AIMA (agency for integration, migrations and asylum), can add another four to five years to the process.”

Indeed, the Americans’ submission – powered by legal experts specialising in immigration – suggests five years could be just the tip of an ‘interminable’ iceberg.

Madalena Monteiro, representing the 15, says the ‘Amicus Curiae’ – lodged as the Constitutional Court inspects the law on the request of PS Socialists – sets out to show her clients ‘reality’."

“That said, it does need to be made clear that having residency in this country, as a foreigner, is every bit as useful as nationality. It gives protection – it simply does not include a Portuguese passport or the ability to vote in national / presidential elections. But thousands of foreigners live large portions of their lives in this country with residencies that they simply renew as and when necessary.“. :roll_eyes:

I feel compelled to say that, from my point of view, Residency pales in comparison to Citizenship. It would seem that “simple renewal” has been a frightful experience for almost everyone reporting on this forum. Why, when other countries issue residence cards for five- or ten-year periods, should cards have to be renewed every two years with the uncertainties of changes in cost or requirements?
It would seem that collecting the full payment on issuance of the first card for a six-year interval would reduce AIMA workload and be a benefit for everyone.
Only Citizenship offers the certainty of protections against unforeseen changes,
and even after interminable delays, fulfills the offered full product for the costs and efforts expended by the applicants of Portugal’s Golden Visa.

In addition to that being BS, they keep forgetting to mention that Residency suffers from the same 4+ year delays as citizenships, and that this has not been fixed. Unlike citizenship, there is no 5 year path to PR and never has been.

It’s really a shame that Portugal Resident felt the need to editorialize, presumably in deference to their advertisers. The Expresso article that they reference explicitly talks about Americans, but we already have the same Schengen access that Portuguese residence offers. The only thing that an American gets from only having residency is the ability to live in Portugal, but there are much easier ways to accomplish that than the ARI program.

That ‘nonsense’ you mentioned is ‘called’ Natasha Donn. She is the ‘queen’ of the ‘opinion piece’ and is never one to ‘pass up’ an ‘opportunity’ to ‘editorialise’.

This is exactly right. Those of us who have been through the AIMA/SEF grinder can certainly be forgiven for being skeptical that our next cards will come when promised (whatever program they come through). We can’t even get renewal cards before the old cards expire. Hell, we can’t even get renewal appointments until the old cards expire.
