Changing from D7 to D8

I entered on a D7 visa before the digital nomad D8 visa was available. My income is actively earned (digital services for US clients), and I pay the same monthly wages to myself via my own US-based LLC. My renewal is coming up in about a year. Will my renewal be subject to the terms of the D7 visa or D8? My lawyers can’t/won’t tell me a definitive answer, which is strange.
