Hello, my loved one was charged with a felony fraud charge in the US over a decade ago. It resulted in probation and no jail time. I would like to know if they would be disqualified for a golden visa, or any other visa? Any insight in what Portugal considers a “clean record” is helpful as well. If they get it expunged would that help or would it still affect obtaining the visa?
My understanding is that if the conviction was for a a crime that was eligible for more than 1 year incarceration (regardless of actual sentence), then that is disqualifying. If this was a federal felony fraud conviction, it would certainly be eligible for more than 1 year in jail. I am a criminal defense attorney.
