Lawsuit Not Filed

We are being now led to believe that it is possible that our lawyers allegedly did not file a lawsuit against AIMA last July, even though they said that they did and received payment for the filing.

They subsequently gave updates to say the the process was being monitored and a positive result was expected imminently.

In December they told us that the lawsuit had been successful and that an AIMA appointment would be shortly available.

A certain lawyer left the law firm in March.

Yesterday we were advised by a new lawyer at the law firm that the possibilty exists that the lawsuit was never filed.

How about that? Certainly a first for us!

Are there documents they’ve provided? You should be able to get official stuff from the court about it.

For example I have a “despacho de citação” and that has a case number and document number, which should all be trackable

Unfortunately not, unless court records are traceable by name.

I have been far too trusting.

When I tried to look up our case myself last year, it seemed the system to do so was only accessible by people registered as working in the PT legal profession.

If you filed against AIMA last July there were probably 30-40,000+ other suits ahead of you at the time. So it’s quite possible your case would still be stuck today anyway. Last stat I saw was January 31st of this year, where there were approximately 50,046 pending AIMA subpoenas.

It would appear the law firm you used still exists. I’d suggest asking for your money back - and maybe that’s for the better anyway.
