Has anyone successfully finished the process of citizenship by investment with a family? Did your children under 18 need to prove anything to become citizens or show language test results? One lawyer told me minors don’t need to pass the language test if they are obtaining citizenship via parents, and another lawyer told me ALL applicants need to prove A2 language, including minors.
Minors do not need pass a the language test.
Minors must demonstrate a “connection with the Portuguese community”. A language test may help but may not be necessary.
More discussion Is GV for children necessary?
If the kids are on the ARI/GV that would count as a connection as they are residents and visit a week every year.
This is a highly misinformed comment. Do you have any citation for this assertion?
This is what a lawyer told me. Remember that to apply for citizenship through parents the children don’t have to be resident in PT - therefore actually being legally resident in PT is a connection.
If IRN will accept that, it is fine. It’s just that is not what the law states.
No, the law states connections, it doesn’t say what those are. It only mentions the school connection, which is automatically considered sufficient. If the child doesn’t have the school connection, then they need others.
@Beanieskis I am afraid you are in a fantasy world. I see that someone previously took the time to research the subject for you and posted a well informed response, yet you still spread information to the contrary of IRN published opinions. I don’t say these words out of spite but to properly inform others on this forum who may be otherwise confused by your over-confident and seemingly inaccurate statements that children only need a GV to prove a connection to the community.
What is the source of the legal opinion from the ministry of justice? It would be great to know.
As I said above, there are some reports of some offices granting citizenship to minors. If IRN will do that without them attending school, it is great. However, I think it is important for people to understand the actual law and not assume that a GV will be sufficient proof of a connection to the community.
Hi
My minor son aged 14 years, submitted a Citizenship application under article 2 ( once my wife got her nationality through GV therefore article 6.1
The lawyer clearly asked to submit more evidence than only residency (he was dependent of the GV ).
The strongest one to prove connexion and ties to the PT community is the language proficiency level A2.
So he passed the e-CIPLE (scholar version for under 16)
The e-ciple a2 certificate in hands we submitted under article 2 ( since a year ) (5+ years residency + e-CIPLE) are the strongest proof of connexion. (with only residency the IRN could ask for more proof of connexion)
One more thing: no need to be resident for the minor to while applying for citizenship.
Yes 100% agreed
GV won t be sufficient to prove connexion.
Language proficiency is a must have and it is considered by the IRN as the proof of connexion
As well as scholarship in a PT school in PT territory with approved programs by the official bodies
What if they are not old enough to attend school or learn Portuguese?
E-ciple scholar version ( for under 16) is the proof of language proficiency for minors (application under article 2)
Of course with residency 5+ years
Right but is there a minimum age for this?
Is a 5 year old expected to take e-CIPLE?
Hi anonymous
Unfortunately not
It s for 12-15 years old
Here is the link for your reference
Okay so how does it work for kids under 12. Is just holding the GV sufficient for them?
Or submit a YouTube video where they say something in Portuguese?
My children would be around 15 when applying for citizenship. My lawyer told me GV residency was enough, and they wouldn’t have to prove language. However, another lawyer gave me a different opinion, that they WOULD have to prove language. Has anyone actually had their kids receive citizenship without the language test? Can children take a 150 hour class instead of doing the ciple test, like adults can?
