What's the potential impact of the 2025 Portuguese election on the Golden Visa program and pathway to citizenship?

PÚBLICO seems to think OE2026 will pass for sure, regardless of Chega. So if you were counting on another PT government collapse to save us from the Nationality Law changes, well…

Budget debate begins with Chega undecided but approval guaranteed

The 2026 State Budget (OE2026) will begin to be debated in general terms this Monday [27th] at 3 p.m. in the Assembly of the Republic, with the document’s viability guaranteed by the abstention of the PS and the guaranteed votes in favor of the PSD and CDS-PP.

With the abstention of 58 PS deputies, the viability of the 2026 State Budget is guaranteed. On the left, the PCP and BE have already announced that they will vote against it and criticized the Socialists’ position.

If I’m not mistaken at least 23 MPs can take it to the CC as well, do they not expect PS deputies to take it to the CC? I had the impression that either the president or the PS deputies will take it to the CC.

I highly suggest getting a 2nd opinion from another lawyer. I’m just a guy on a forum, but that sounds like horrible advice to tbh. If you are so close to having a legit application, i wouldn’t throw that away - the sense of a lot of people here is that promulgation might take a while and that the law is more likely than not to be referred to the Constitutional Court to be reviewed, which would buy you the time you need.

I’m trusting the attorney, but definitely see your point. If in fact the law does take effect on wed we would 100% be screwed. She framed it definitely 10 years if we don’t submit, and possibly 5 years if we do submit.

But at this point it’s anyone’s guess, I think.

Check with your lawyer if it is possible to withdraw the application after it is put in. I get trying to capture the 5 year window, but if anything happens to delay implementing the law, I think it would be safer to withdraw the “early” application and submit a new one after the real 5-year mark.

The thing I’m also struggling with is that, if they do change it, who’s to say they won’t change it again… And again… And again? I’m just disappointed.

Intriguing comments here: Portugal’s Golden Visa reform sparks legal and constitutional debate over citizenship rules - The Portugal News

The article lost me at the first sentence: hurry up and apply!

Further in, it clarifies that if you’re already eligible for citizenship you should get your application in immediately.

That’s the most terrifying part. Someone can spend tens of thousands in renewal fees and years of life and who knows what punitive changes may be lurking around the corner.

I was referring to the Paul Stannard quote:

"Explains Paul Stannard, founder and CEO of Portugal Pathways, a company which specialises in helping high-net-worth individuals navigate the path to a life in Portugal: 'There has been a lot of concern about the discussions in parliament last Friday and the constitutional issues it throws up.

However, many legal experts we have spoken to in the last few days are anticipating a number of challenges over the citizenship timeline before anything becomes law.

If this moves forward, it has to go to the President, who will then decide if this is a constitutional issue - our legal partners believe it is a significant one - before it can come back, rejected, amended or signed into law.

It is widely expected that it will be referred to Portugal’s Constitutional Court. All of this will take a little bit of time.'"

Also this: “Current residence holders who haven’t applied yet will not be shielded, meaning they’ll likely fall under the new 10-year requirement.
This has raised concerns among lawyers and campaigners, with [Lawyer Madalena] Monteiro warning of a “high probability” of a Constitutional Court review of Article 5.”

Bill is likely to pass today PSD e Chega fecham acordo para aprovar lei da nacionalidade – Observador

Let’s hope the president and constitutional court work together to strike down the lack of grandfathering.

Extremely disappointed with the latest development, pile that to my awful experience with my lawyers and I’m so lost.

You’re not missing anything in my opinion. I’m in it and it’s just a bunch of off-topic discussion. Mostly people venting their personal grievances.

Okay, I would be very interested in being a part of the lawsuit if you’re powering through. Thanks.

Yeah posting was restricted in the group now as there were 300+ people not talking about organising a lawsuit, but just venting frustrations generally, so the admins muted it for now. Supposedly it’ll be opened up again pending what happens in parliament and the TC.

I really feel a bit let down
by Portugal. After getting all the police clearances and all the other
documents and all the apostilles! And at great expense I might add, our lawyer then tries to upload all said docs for citizenship application, only to be told online that our residence cards are out of date! We renewed both cards in September and haven’t received the new ones yet, so
we are really stymied
