can you use the expired card and the renewal receipt instead?

I don’t know how our lawyer would be able to document the attempt to upload. And she couldn’t use the expired card and receipts of renewal

That is concerning. Please send any updates. We plan to apply in December and while I have a valid card, the family does not (appointments in February for 3 of them with a 4th in limbo - since formal cards expired 18 mos ago)

Screenshots. And whatever error/message they got about expired residence cards. At some point the government has to take responsibility for their failures. If you are indeed eligible for citizenship already then you have the right to apply. Expired residence card shouldn’t be your problem. It may be enough to talk to the Conservadora and submit a manual application.

that’s just the leader of CH blowing smoke. He’s saying he’s whipped the votes, nothing more. That’s not the end, though. If it passes it will still need to promulgated and survive any constitutional challenges. The foreigners law passed in June was similarly harsh and did not survive those last steps.

I would appreciate clarification on an important matter that may be relevant to the potential lawsuit concerning the Golden Visa program changes.

If legal action is pursued, will it cover all Golden Visa (GV) applicants who submitted their applications before the new law takes effect, or only those who have already received approval or their residence cards?

Many applicants remain at various stages of the process—awaiting pre-approval, biometric appointments, or their initial residence cards. Their legal counsel has advised that they will remain subject to the original five-year rule, with the understanding that the new law will not be applied retroactively.

However, given the ongoing uncertainty surrounding this matter, I am seriously considering withdrawing both my investment and application should the law ultimately be approved.

Indeed. I will be very, very surprised if this bill gets past the Constitutional Court in its current form (thank you, Sr. Miranda!)

And may I add that it was an absolute master stroke on the part of Madelena Monteiro to request Sr. Miranda’s opinion pre-emptively?

So far the details are still uncertain, the group appears to be trying to get legal advice as to what the best approach is. I believe the idea is to fight for the previous rules (e.g. 5 years from application + A2 certificate) to apply to anyone who had submitted their application before the new law takes effect. As for the details, including whether it would be a class action, one action with many plaintiffs, or many separate but similar cases, that is as of yet undefined as the group is awaiting input from some of the lawyers who are present.

I will say that I think any such lawsuit is a bit of a stretch, and a last resort only, so please write the President if you haven’t already, and focus on applying pressure before the law is promulgated.

Even the “watered down” changes are still very harsh! They still added language and civics requirements for family members of GV to renew: New (2025 Oct) language and civics requirements for family members renewal

And for non-GV visas, e.g. D7, they must now wait 2 years before the spouse can join!

There’s not been much clarity around what those language and civics requirements mean in practice. ARI was exempted from the rest of the changes to the foreigners law and I’d hesitant to describe those as harsh without actually knowing what those changes even mean.

Thank you! I just sent an electronic message via the “contact form”. At this point, I honestly suggest we flood the zone with concerns of unconstitutionality, if nothing else, to encourage him to get an opinion on it. Let’s at least slow the roll.

Now is the time to plea for his help uphold the investors’ rights through contractual agreements and our legitimate expectation of 5 year eligibilty to the nationality.
